Subpoenas Unblocked in Case Involving PM Browne

In a significant ruling, U.S. District Judge Jesse M. Furman has lifted a temporary hold on subpoenas related to the ongoing allegations against Gaston Browne and his family.

This decision allows for the production of records from wire transfer clearing houses that are being investigated.

The ruling came after Yulia Guryeva-Motlokhov, the applicant, requested that the court remove the stay to expedite the discovery process. Judge Furman acknowledged the applicant’s concerns about unnecessary delays and determined that a balance needed to be struck between the applicant’s interests and the privacy claims raised by the intervenors, which include Browne and his associated entities.

To address these privacy concerns, the court has mandated that any responses to the subpoenas will be protected under a confidentiality order requiring that the information be classified as “Attorneys-Eyes-Only.”

This means that the details will remain confidential until further court orders are issued. Additionally, if any motions to quash the subpoenas are granted later on, the sensitive information must be destroyed.

The judge has directed both parties to collaborate and submit a proposed protective order by April 25, 2025, ensuring that there is a framework in place to safeguard the privacy interests of the intervenors.

Judge Order reads as follows:

MEMO ENDORSEMENT on re: [38] Response in Opposition to Motion,, filed by Yulia Guryeva-Motlokhov. ENDORSEMENT : Upon review of the parties’ letters, the Court concludes that the proper way to balance Applicant’s interest in avoiding unnecessary delay and Movants’ privacy interests is to lift the stay and require production subject to a protective order providing that any responses to the Subpoenas are to be held on an Attorneys-Eyes-Only basis until further order of the Court and are to be destroyed to the extent that the Court grants a motion to quash. Applicant and Movants shall confer and, no later than April 25, 2025, file a proposed protective order. SO ORDERED. (Signed by Judge Jesse M. Furman on 4/22/25) (yv)
