Belgium’s highest court has dealt a decisive blow to Mehul Choksi, rejecting his latest attempt to block extradition to India and clearing the way for his surrender to face fraud-related charges.
In a ruling this week, the Court of Cassation dismissed Choksi’s appeal, describing the objections raised by the Antiguan national as without merit.
The court found that he failed to present any credible legal or factual basis to overturn earlier decisions that authorised his extradition.
Choksi, who holds Antiguan citizenship and has been living in Europe while contesting extradition, is wanted by Indian authorities in connection with a massive financial scandal involving alleged bank fraud.
He has consistently argued that his extradition would violate his rights and has raised concerns about due process and personal safety if returned to India.
However, the Belgian court ruled that those claims did not meet the threshold required to interfere with the extradition process. By upholding the lower court’s findings, the Court of Cassation effectively exhausted Choksi’s legal avenues within Belgium.
The decision marks a significant development in the long-running case, bringing Indian authorities closer to securing Choksi’s return after years of legal challenges across multiple jurisdictions.
