A lawyer representing Claude Steadroy James has submitted a petition to the court in an attempt to get his client’s case dismissed.

The Attorney argued on Tuesday that his client has no case to answer because the prosecution has not presented enough evidence that his client mowed down a woman and killed her.

James has been on trial over the past two weeks before Justice Tunde Bakre, accused of causing death by dangerous driving in relation to Elba Perez, who was struck by a vehicle on Joseph Lane on the night of April 13, 2021, and later died in hospital.

The medical report from the hospital outlined that on arrival, Perez was bleeding profusely from lacerations to the roof of her mouth, the first part of the tongue, and upper lip, and had bruising around the left eye, she was not reacting to light while her right eye reacted slowly to light.

She had fractures to the back and front of her ribs, as was seen on a Chest X-ray, and also bleeding in the brain.

The Judge is preparing his ruling on the matter.
