Two residents of Barbuda are preparing to continue their challenge against the construction of a runway for the international airport on the island.
They sought justice and protection of their land rights, and now their appeal has been allowed by the Privy Council.
As a result, they are re-filing their case for a Judicial Review, allowing the matter to proceed.
The decision has emboldened other Barbudans to come forward with their own legal challenges against the government.
This ruling is expected to have far-reaching implications, as it may open the gates for more litigation.
The residents are particularly concerned about various development projects that they feel may negatively impact their environment and livelihoods.
They are also challenging these developments.
The ruling by the Privy Council was made on February 27, 2024, following a hearing on November 8, 2023.
The law lords were asked to consider whether a previous decision was relevant to this case.
