Eversleigh Warner, one of the constituents mounting a legal challenge against Anthony Smith’s status as an Independent Member of Parliament (MP), has publicly addressed the motivation behind this action for the first time.

Speaking at a United Progressive Party (UPP) rally in Sea View Farm on Thursday night, Warner expressed confidence in the success of their court challenge.

Warner’s Key Arguments

  1. Voter Intent: Warner emphasized that he voted for Smith specifically because he ran on the UPP ticket. “When I casted my vote during the last election, I casted it for a man who said to me that he is representing the UPP,” Warner stated.
  2. Breach of Trust: He asserted that Smith has betrayed the trust of his constituents by joining the Gaston Browne Cabinet. “You cannot then leave the legislature and become a part of the executive, in whose interest?” Warner questioned.
  3. Definition of Independence: Warner called for the court to clarify what constitutes an independent MP. “I want the court to decide what is independent. Can you be independent on one hand and then on the other hand, you’re gone over, gone swear secrecy?”
  4. Call for By-Election: Warner believes the court should declare the All Saints West seat vacant, necessitating a by-election. He suggested that if Smith wishes to represent the Antigua Labour Party, he should run on their ticket in such an election.

Background and Current Status

  • Anthony Smith left the UPP in July, prompting this legal action.
  • Smith is now serving as the Minister of Agriculture in the Gaston Browne Cabinet.
  • The case was initially brought before the High Court on October 8 but has been adjourned to November 5.
  • Justice Jan Drysdale expects Smith’s lawyers and government representatives to file their responses by the next hearing.

Potential Outcomes

Warner speculated that if the court rules in favor of the constituents and declares the seat vacant, Prime Minister Gaston Browne might opt to call a general election rather than a by-election.

This legal challenge underscores the complex issues surrounding political representation and party loyalty in Antigua and Barbuda’s parliamentary system. The outcome of this case could have significant implications for how MP independence is interpreted and handled in the future.

  1. Faithful national #1

Does every pronouncement alleged to be emanating from comical UPP squawk-box have to be assembled by the editorial team of their out of touch, depassé “journalists”? Who they think they fooling? I hope that that selected squawker among the mega crowd in attendance at the UPP’s rally the other night. The jokes just keep coming 🤣
