PM Browne Seeks Public’s Advice on Removing Judges Over Lenient Sentences

Prime Minister Gaston Browne is seeking the public’s views on whether members of the Judiciary accused of repeatedly imposing lenient sentences on serious and repeat offenders should be removed from Antigua and Barbuda.

In a public statement, Browne expressed concern that judicial discretion is being abused, arguing that some sentences do not reflect the seriousness of the crimes committed or adequately protect the public.

The Prime Minister noted that Parliament had increased the maximum sentence for gun crimes to 15 years. However, he said lawmakers were advised by members of the Judiciary not to establish mandatory minimum sentences because doing so could restrict judicial discretion and trespass on the Judiciary’s constitutional domain.

Browne claimed that despite Parliament respecting that advice, some judicial officers are imposing short sentences on repeat offenders and individuals convicted of heinous crimes.

“However, we find that some in the Judiciary are abusing the discretion in law by imposing lenient sentences on repeat offenders and others who have committed heinous crimes,” the Prime Minister stated.

According to Browne, the imposition of short sentences has contributed to approximately 250 repeat offenders returning to the country’s communities. He argued that this is stretching the capabilities of law enforcement agencies and placing the wider society at risk.

The Prime Minister also raised the possibility of the Executive seeking the removal of what he described as underperforming members of the Judiciary from the jurisdiction.

He went further by asking whether, in cases involving non-belonging judicial officers who are not removed through the court system, the Executive should consider exercising its authority to remove them from the state on national security grounds.

“Alternatively, if the court refuses to remove them from the jurisdiction and they are non-belongers, should the Executive exercise its right to remove them from the state in the interest of national security and protection of the citizenry from these criminals?” Browne asked.

The Prime Minister ended his statement by inviting members of the public to offer their views on the controversial issue.

His comments are expected to trigger further debate about judicial independence, the constitutional separation of powers and the responsibility of the courts to impose sentences that punish offenders, deter criminal activity and protect society.
