Government to Introduce Minimum Sentences for Serious Gun Crimes and Sexual Offences Against Minors

The Government of Antigua and Barbuda will introduce legislation establishing minimum and maximum sentences for serious gun crimes and sexual offences committed against minors.

The decision followed extensive Cabinet discussions on the recent increase in gun-related crime and violence and the need to strengthen the country’s criminal justice system.

Before the proposed legislation is finalised and presented to Parliament, the Government will consult relevant stakeholders to obtain legal and technical advice.

Cabinet said the move represents a further development in the Government’s review of sentencing policy. Parliament previously increased the maximum penalties for serious firearm offences, while Prime Minister Gaston Browne has repeatedly argued that some sentences have not provided a sufficient deterrent.

The proposed legislative process will be undertaken within the constitutional framework governing the respective responsibilities of Parliament, the Executive and the Judiciary.

Cabinet said the Government’s response to crime will extend beyond sentencing and include stronger policing, prosecution, technology, correctional reform and rehabilitation.

The Government has also pointed to its introduction of anti-gang legislation, increased penalties for gun offences and expansion of law-enforcement resources as part of its response to violent crime.

Cabinet reaffirmed that the safety and security of residents remain paramount and pledged to continue strengthening the criminal justice system to deter serious crime, prosecute offenders and protect the wider society.
