The Inland Revenue Department (IRD) is facing legal action from Sandals Resort and Spa, which is seeking a new assessment of its tax liability in the High Court.
Sandals claims that Commissioner Ralph Warner ignored procedural requirements in the latest assessment.
Warner argues that the resort is attempting to delay the process and emphasizes that it is the company’s responsibility to address any dissatisfaction with assessments through the proper legal channels.
He explains that the IRD has the authority to assess businesses in Antigua and Barbuda and recalls that Sandals had an agreement to remit the full amount of the ABST it collected starting January 1, 2017, after initially deducting funds.
However, the resort reverted to making deductions, leading to an assessment of approximately $27 million for 2017-2021, including $2.3 million in withholding tax.
