A trial scheduled for yesterday at the All-Saints Magistrate’s Court did not proceed when Police Sergeant Karim Warner failed to appear, drawing sharp criticism from Magistrate Ngaio Emanuel.
The case involves serious charges of discharging a firearm in a public place and assault, stemming from an incident on December 3, 2023, where Warner allegedly fired 12 rounds at a white Toyota Mark X containing two civilians.
Warner submitted a sick leave document claiming an upper respiratory tract infection, which ends on December 10 — the same date Magistrate Emanuel planned to conclude her annual case docket.
Neither Warner nor his attorney, Andrew O’Kola, were present in court, with O’Kola’srepresentative citing an unspecified emergency.
Magistrate Emanuel expressed significant frustration with the proceedings. Her concerns centred on multiple suspicious leave applications, the questionable timing of Warner’s illness, and what appeared to be a coordinated effort to delay the legal proceedings.
The magistrate’s observations highlighted several troubling aspects of the case, including a previously missing case file that was recently located.
Magistrate Emanuel noted that in her 11 years of service, she had never encountered such repeated attempts to postpone a trial.
In response to the apparent delay tactics, the magistrate suggested reporting the situation to the Commissioner of Police, emphasizing the case’s sensitivity and Warner’s status as a suspended police officer.
She was particularly critical of how these repeated postponements damaged the judiciary’s public perception and wasted valuable court time.
The trial will now proceed on February 10, 2025, with Magistrate Emanuel making it clear that she will not entertain further leave applications or attempts to delay the proceedings.
That sick leave a little too convenient
It’s almost as if these justice system only work on the police and them behalf. Where’s the bench arrest? Cause to my knowledge one was issued for the young lady who missed her court hearing. Doesn’t this due the same for him?? Oh wait she’s a regular civilian and he’s a sergeant.
