Jason Millette and Shalom Bailey are no longer facing murder charges in connection with the death of Xavier Thomas, who was killed in Cedar Grove on August 18, 2017.
The Director of Public Prosecutions filed a nolle prosequi to formally withdraw the charges against both men.
This prosecutorial decision comes after the Court of Appeal’s ruling last week, which quashed the murder conviction of their co-accused, Dorian Marshall. The appellate judges found that the evidence presented to secure Marshall’s conviction was deficient, prompting them to overturn both his conviction and his 40-year prison sentence. The court went further, ruling that Marshall cannot face retrial for the offense.
Similarly, in 2023 Bailey and Marshall who were also defendants in another homicide – the 2017 killing of Charlesworth Richards Jr., a 42-year-old man who died in Ras Freeman, Liberta-walked free.
Richards was shot multiple times and died at the scene after assailants allegedly breached his property by climbing over a rear gate. The attackers reportedly demanded money and drugs before stealing Richards’ SUV to escape.
When police processed the crime scene on June 21, 2017, they uncovered spent ammunition shells along with an extensive cannabis cultivation operation, including thousands of marijuana plants and several pounds of processed cannabis.
The prosecution dropped this case in 2023.






Did we expect a different outcome? If I have to answer my own question then It will be NO. We live in a place where justice will never be served until God comes.
This case is just going to wash away like surface water. Put your head to the games. No justice for Xavier. Will her family go silent? Or will we make nose?
Saw a post on true crime the other night and it stand so real! We will never get justice for this young lady. Marshall was set free and now no one stands a suspect in this case.
One thing I know…the justice system can allow killers and criminals to walk free but there’s a judge we cannot hide from. This is comforting
Our worst DPP ever!!!! Expect more of the same that occurred during this grossly incompetent DPP. What a shame!
It’s hard for families of victims to hear news like this. It must feel like a punch to the gut. But from a legal standpoint, if the Appeal Court found valid grounds, like an abuse of process or insufficient evidence, the DPP’s hand might have been forced. It’s a tough balance between justice for victims and upholding the law correctly.

Well sahhhh. Dis is Antigua for you eh. How can the charges just be dropped like that? Xavier Thomas lost his life, and it feels like justice is being ignored. This sends a terrible message about accountability. It’s infuriating to see the legal system fail the victim and their family like this. What does it mean for justice when those responsible can just walk away?
Jason mussi have 9 life but these two are bad egg. I’ve worked in the court system for 20 plus years and they’ll be handled one way of the other.
The streets will do what the courts can’t.
