
Guilty-Plea Discounts Must Be Reviewed, says PM Browne
Prime Minister Gaston Browne is calling for an urgent review of sentencing discounts that allow defendants to receive reductions of up to one-third after pleading guilty.
Browne said he understood the purpose of rewarding early guilty pleas, including saving judicial time, reducing costs and sparing victims the ordeal of a lengthy trial.
However, he argued that the present level of discount was excessive when applied to repeat offenders and people caught committing serious firearm or sexual offences.
“You are telling me that all they have to do to get their reduction of a third is to plead guilty? I’m saying no. That is not how the system should work,” Browne said.
The Prime Minister contended that a guilty plea should not automatically result in a substantial reduction where the evidence against the accused is overwhelming.
He proposed a different approach under which offenders who unnecessarily plead not guilty and force the court to conduct a full trial could face a higher penalty if convicted.
Browne said this would discourage defendants from wasting the court’s time without drastically reducing the punishment attached to the original offence.
He also suggested that any guilty-plea reduction granted to a repeat offender should be significantly smaller than the maximum discount available to a first-time offender.
According to Browne, the current system is particularly problematic when the starting sentence is already low and the offender later qualifies for another reduction while serving time in prison.
He said the sentencing guidelines must be revised to ensure that the final punishment remains proportionate to the seriousness of the crime.
