Justice Jan Drysdale has dismissed a constitutional challenge to Agriculture Minister Hon. Anthony Smith Jr.’s position as an Independent Member of Parliament.
The case, brought by constituents of All Saints West, was thrown out due to insufficient evidence.
The ruling came after Smith’s attorney, Dr. David Dorsett, successfully argued that the constitutional motion lacked valid grounds and contained defective evidence.
The legal challenge emerged following Smith’s departure from the opposition United Progressive Party (UPP) and his subsequent appointment as a government Minister.
The case raised questions about Smith’s parliamentary status after his transition from opposition member to independent MP serving in the government cabinet.
